An appellate court out of Spokane, Washington recently observed this: “Just as no plan of battle survives first contact with the enemy, it appears no plan of construction survives first contact with the elements.” General Construction Company v. PUD District No. 2 of Grant County, 195 Wn. App. 698 (2016). Just as change occurs on construction projects, it occurs in the law too. In turn, these changes may impact parties’ contractual risk allocation.
